"Administrative Measures on Tendering and Bidding of Government Procurement Goods and Services" was

On July 11, 2017, in order to implement thedecision-making arrangements of the Party Central Committee and the StateCouncil, and to meet the needs of the reform and development of the governmentprocurement system, the relevant provisions of the "Regulations of thePeople's Republic of China on Government Procurement Law" wereimplemented, and the Ministry of Finance had "government procurement ofgoods and services." The Measures for the Administration of Bidding andBidding were revised. Before the amendment, there were 6 chapters and 90articles. After the amendment, a total of 7 chapters and 88 articles weredeleted. Compared with the amendment, 36 articles were deleted, 34 articleswere added, and 54 articles were revised. The revised "Measures" (Ministryof Finance Decree No. 87) will be implemented on October 1, 2017. The Measuresfor the Administration of Public Bidding for Public Procurement Goods andServices issued by the Ministry of Finance on August 11, 2004 (Ministry ofFinance) No. 18) Abolished at the same time.

The Ministry of Finance Decree No. 87, inaccordance with the government procurement of goods and service operationprocedures, stipulates the sub-chaptering for bids, tenders, opening bidevaluation, bid winning and contract, and legal liability. Responsible for themain responsibility of the purchaser, clarifying the key responsibilities ofthe purchaser in the implementation of procurement policies, strengthening ofinternal control, preparation of procurement requirements, open procurementinformation, and performance acceptance, while increasing the purchaser'sparticipation in procurement activities and rationally expanding procurementPeople’s purchasing autonomy further strengthens the reciprocity of rights andresponsibilities.

 In response to outstanding issuessuch as high quality, dark recall, and low efficiency, Order No. 87 furtherimproved the system design and standardized procurement practices, and focusedon strengthening procurement requirements, performing acceptance inspections,strengthening the supervision of review behaviors, and enhancing thetransparency of government procurement and strengthening Party parties’ legalresponsibilities and other aspects have proposed targeted measures.
